seller warrants that all products manufactured by it will, under proper installation, use, and service, be free from defects in workmanship and material. in the event of breach of the foregoing warranty, seller will at its option, repair or replace F.O.B. seller's plant the product in question, provided, in all such cases, that (1) seller receives written notice of the breach within twelve (12) months of the date of shipment from its factory, and (2) the product in question is returned, freight prepaid, to sellers factory for inspection and such inspection establishes that the product is defective. SELLER MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO ITS PRODUCTS AND ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE IS EXPRESSLY DISCLAIMED. seller's liability under this warranty or otherwise with respect to its products or their use (including liability for negligence or otherwise in tort) is limited exclusively to the remedy provided above, and no other right or remedy will be available to any person. Seller will, in no event, be liable to any person for any special, incidental, or consequential damages to person or property, except to the intent mandated by applicable state law. no person is authorized to extend or in any way vary Sellers obligations hereunder or in connection herewith, and any representation or warranty made by any sales representative or other agent or representative of sour which is not specifically set forth herein shall not be binding upon seller. |
